Music copyright issues P1

1) Right of use
Publishing rights - 
If the Music you're intending to you has already been released and published through a label, then you must get consent to legally use their music in your movie if you want to use their composition. 
Recording rights- 
You must get a license from the people/person who originally recorded the track. You will need to hunt down the owner and ask them for permission.

If you don't get license to use music off the owner/creator you can face trying to be sued by the owner as you will be selling their work without their permission. 

You will need to make sure you clear any music used, if background music has been captured Eg. a Radio. if it was unintentional music and has been kept to add atmosphere it is incidental. If the music has been intentionally used and put in place you will need to gain clearance to use it.

If the Creator of the music has died you will need to source out the owner of the piece in most cases it will be the record label which the artist was signed to when they made the track.

What is creative commons?
CC means that the piece of material has creative commons it means it can be taken and reused in anyway and remixed legally without getting any clearance from the creator.
It exists so Artists who want their work to be able to reused and made more popular by other using it over and over again.
6 Types of CC

CC BY : this means that other people can change, tweak and remix but only if they give credit to the original creator.
CC BY NC ND: This means people can share work and download although they must give credit and must not sell your work in anyway.
CC BY NC SA:  This lets others change and tweak the creators work but they cannot use it commercially and must give credit to the original creator.
 CC BY NC: This means that others can change and tweak the original work non commercially and they must tell the original creator before doing anything.
CC BY SA: Often compared to copyright free, this lets anyone change tweak and remix and will be on the same license. The work can also be used commercially 
 CC BY ND:This license allows for redistribution, commercial and non-commercial, as long as it is passed along unchanged and in whole, with credit to you.


My Music choice
I Created my soundtrack myself using garage band loops this way i could get the right BPM i wanted for my clip and would set the mood to how I wanted it. My music piece was very basic featuring one sound effect a long with a hip hop drum beat.
As i made my music i did not need to get any permission to use it.
